TERMS & CONDITIONS

Welcome to FabLab LLC ("FabLab," "we," "our," or "us"). By accessing our website located at https://fablabllc.com (the "Site"), booking appointments, or engaging our services for general automotive maintenance, custom work, or fabrication, you ("Customer," "Client," or "User") agree to be bound by these Terms and Conditions. Please read them carefully.

1. Acceptance of Terms

By using our Site, contacting us for estimates, or dropping off a vehicle or components at our shop located at 3620 Mill Creek Avenue Northeast, Comstock Park, Michigan 49321, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree, you must not use our Site or services.

2. Scope of Services

FabLab LLC provides professional automotive services, including but not limited to:

  • General Maintenance: Diagnostics, preventative care, repairs, and standard servicing for daily driver vehicles.

  • Custom Work: Performance upgrades and specialized vehicle modifications.

  • Fabrication: Bespoke metalwork, welding (e.g., aluminum and steel), and custom engineered component fabrication.

All services are performed by appointment. Operating hours are Monday through Friday, 8:00 AM to 5:00 PM (Closed Saturdays and Sundays).

3. Estimates, Quotes, and Pricing

  • Estimates: Any verbal or written estimate provided prior to teardown or physical inspection is an approximation based on initial findings.

  • Hidden/Unforeseen Damage: If additional issues, hidden damage, or complications are discovered once work has commenced or components are disassembled, we will contact you to explain the required additional labor and parts before proceeding.

  • Pricing Changes: Prices for parts, materials, and labor are subject to change based on market availability. All invoices must be paid in full prior to the release of any vehicle or fabricated parts.

4. Custom Fabrication & Specialty Projects Waiver

  • Bespoke Nature: Custom fabrication and specialty modifications (including custom wiring, welding, and non-factory structural adjustments) are performed to customer specifications or tailored design requests.

  • Off-Road / Track Use: Unless explicitly certified otherwise, custom-fabricated parts, performance upgrades, and modified vehicles are intended for off-road, track, or show use. Customer assumes all liability for compliance with local, state, and federal vehicle registration, inspection, and safety codes.

  • Design Approval: For custom builds, the client is responsible for reviewing and approving design parameters. Changes requested mid-production may incur additional labor and material charges.

5. Payment Terms & Storage Fees

  • Payment Due: Payment is due in full upon completion of services and prior to vehicle pickup or part delivery, unless prior written arrangements have been agreed upon. We accept standard forms of payment as communicated by our shop.

  • Storage Fees: Vehicles or components left unclaimed for more than seven (7) calendar days following notification of completion will be subject to a daily storage fee of $50.00 per day, unless alternative arrangements have been made in writing.

  • Mechanic's Lien: FabLab LLC reserves and asserts a mechanic’s lien under Michigan law upon any vehicle or property for unpaid charges for labor, materials, storage, or diagnostics.

6. Warranties and Limitation of Liability

  • Workmanship: We take pride in our craftsmanship and stand behind our labor quality. Specific manufacturer warranties apply to new replacement parts installed by FabLab.

  • Exclusions: FabLab is not responsible for pre-existing conditions, failures of unrelated components resulting from standard wear and tear, or customer-supplied parts. Any warranty on custom fabrication is voided if the parts are subjected to abuse, misuse, improper maintenance, racing, or unauthorized modification.

  • Limitation of Liability: To the maximum extent permitted by Michigan law, FabLab LLC’s total liability for any claim arising out of or relating to our services or website shall be strictly limited to the total amount actually paid by the customer for the specific services rendered. FabLab is not liable for indirect, incidental, special, or consequential damages, including loss of use, rental car costs, or lost business revenue.

7. Vehicle Drop-Off, Testing, and Personal Property

  • Risk of Loss: Vehicles left at our facility are parked at the customer's risk. Customers should remove all valuable personal property from vehicles prior to service. FabLab is not responsible for lost or stolen personal items left inside vehicles.

  • Test Driving: You authorize FabLab technicians and staff to operate your vehicle on public roads, highways, and testing facilities for diagnostic, repair, and quality-control purposes.

8. Intellectual Property & Website Use

  • Site Content: All text, graphics, logos, images, portfolios, and design layouts on this Site are the property of FabLab LLC and ANK Creative Branding (where applicable) and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without express written permission.

  • User Conduct: You agree not to use the Site for any unlawful purpose, to transmit harmful code, or to interfere with the operation of our web services.

9. Governing Law and Dispute Resolution

These Terms and Conditions and any separate agreements whereby we provide services to you shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Kent County, Michigan, and you consent to the personal jurisdiction of such courts.

10. Changes to Terms

We reserve the right to modify or update these Terms and Conditions at any time at our sole discretion. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our Site or services following any changes constitutes your acceptance of the revised terms.
